RussianLegal secures reversal of an adverse ruling in the court of appeal

The Moscow City Court has upheld an appeal filed by RussianLegal attorneys and overturned a decision of the Dorogomilovsky District Court that had ordered the firm's client to pay unjust enrichment and interest.

The dispute involving one of RussianLegal's clients was unprecedented. Several years ago, the client fell victim to fraud. In 2022, they managed to secure justice: the damages were compensated by a third party, and the accused was convicted.

However, in February 2024, the opposing party sent the client an ultimatum demanding the conclusion of a transaction, allegedly as a condition for the damage compensation by the third party. Subsequently, the opponent changed tactics and filed a lawsuit to recover unjust enrichment and interest for the use of funds from the client. The claim was based on the argument that the client's refusal to enter into contractual relations with the opponent meant they had no right to claim compensation for damages caused by the crime. Despite the highly questionable nature of this claim, the court of first instance ruled in favor of the plaintiff.

In the appellate instance, RussianLegal's lawyers successfully convinced the court that this decision was unlawful. They secured its complete reversal and proved that compensation for damages suffered by a victim of a crime cannot and should not be contingent upon entering into any transactions.
