RussianLegal together with the Association of Lawyers of Russia hosted a session on preventive measures at the XIII St. Petersburg International Legal Forum

A session was held at St. Petersburg International Legal Forum-2025 on the topic: “Preventive Measures against Business Owners and Top Managers: Reform Results and Prospects”. The participants discussed initiatives to limit the incarceration of entrepreneurs, as well as further steps to create an effective system to stop criminal prosecution of business representatives.

Andrey Kozlov, Managing Partner of RussianLegal, took part in the session.

The session was moderated by Vladimir Gruzdev, Chairman of the Board of the the Association of Lawyers of Russia. Speakers also took part in the session:

During the session, Andrey Kozlov put forward three proposals to amend The Criminal Code of the Russian Federation and The Criminal Procedure Code of the Russian Federation, in particular, he suggested introducing a fundamentally new approach to the definition of entrepreneurial activity in criminal proceedings:

To activate the guarantees of The Criminal Procedure Code of the Russian Federation in relation to entrepreneurs, it is sufficient to remove the discretion of the investigator and introduce a simple test: if the victim is a commercial organization, entrepreneurial activity is presumed.

The above measure, according to Andrey, will avoid the subjective assessment of investigators

It is also proposed to introduce departmental and personal responsibility of investigators. Departmental responsibility implies that in case of gross violation of legal rights and guarantees of entrepreneurs by an investigator, the case is grounds for referral to the Investigative Committee of the Russian Federation. Personal responsibility implies the application of prosecutor's response measures directed at a specific official.
