In the course of a family conflict, the father took the child to Montenegro against the will of the mother, who provided care and medical supervision for the child suffering from a neurological disease, and has wrongfully retained him there until the present day.
With the active and direct involvement of the Law Office's lawyers, the High Court of Podgorica (Montenegro) upheld the decision of the Basic Court of Kotor (Montenegro), which satisfied the mother's claims for the return of her son to Russia in accordance with the Convention on the Civil Aspects of International Child Abduction of October 25, 1980, and imposed obligations on the child's father to return the child under threat of enforcement.
In addition to applying judicial protection measures, the Office succeeded in having the Investigative Committee of Russia initiate a criminal case against the father on the grounds of vigilantism, which is rare in domestic law enforcement practice. The criminal case is still under investigation.
The Law Office is currently preparing cross-border measures for the actual transfer of the child to the mother and his return to Russia.
