The essence of the conflict:

A Latvian bank applied to a large hotel business (formerly part of one of the world's most famous hotel chains) with claims for foreclosure of pledged property belonging to the hotel chain. The claims were based on loan agreements that were “allegedly” concluded by the principal back in 2016 against the pledge of real estate - hotel buildings.

The foreign bank obtained this claim through a convoluted scheme of fictitious debt, between several legal entities in offshore jurisdictions, which required significant efforts to collect and analyze evidence for presentation in court.

The Law Office Actions

A new litigation support strategy was developed (5 parallel trials in different regions of the Russian Federation).

1.
Identified fictitious document flow schemes used by the bank to create claim rights.
2.
The dispute was complicated by the application of foreign law and complex legal issues under Russian law that had no solution in court practice. The lawyers obtained and attached to the case file the necessary expert opinions.

Result

1.
The Law Office obtained a declaration that the loan agreements were null and void and foreclosure was denied.
2.
The settlor's business is preserved.
